We are no longer accepting cases regarding these products. Due to a terrible Supreme Court ruling, consumers injured by this product are no longer permitted to sue the manufacturers of this device. We wish we could help, but the Supreme Court has taken the rights of citizens away to protect the profits of medical device manufacturers. For more information, please read the following New York Times article entitled “Medical Device Ruling Redraws Lines on Lawsuits.“
A 2004 study published by JA Holloway et al. in American Journal of Surgery titled “The Lap-Band is an effective tool for weight loss even in the United States.” explains that while the Allergan LAP-BAND gastric banding system performs its function relatively-well, leading to percent excess weight loss rates of about 65% after 3 years, LAP-BAND use carries with it a number of serious complications.
This study, available by following the link above, found that of 504 patients, “Complications occurred in 96 patients (19%) primarily consisting of port tubing separations, slips, postoperative dysphagia, and port infections.”
Due to the fact that the rates for these complications are commonly determined to be higher than those reported by Allergan, a number of Allergan LAP-BAND lawsuits were filed.
